Ai Pals, Inc. Service User Agreement

1. Introduction
1.1. This User Agreement ("Agreement"), together with AI Pals, Inc.'s Privacy Policy (available at www.aipalsinc.com /about/privacy), governs your use of AI Pals's websites, mobile applications, and services (collectively, the "Services").
1.2. AI Pals, Inc. ("AI Pals," "we," "us," or "our") is a California corporation headquartered at 4251 Freemark Avenue, Merced, CA 95348.
1.3. By using our Services, you agree to be bound by this Agreement and any future amendments.
2. Legal Notices and Class Action Waiver
2.1. Class Action Waiver: You agree not to participate in a class action lawsuit against AI Pals. You retain the right to bring claims against AI Pals as an individual plaintiff.
2.2. Governing Law: This Agreement is governed by California law, with exclusive jurisdiction in the state and federal courts of Merced County, California, except where mandated otherwise by applicable law.
3. Eligibility and Account Registration
3.1. Age Requirements:
- United States: Must be at least 16 years old
- Other countries: Must meet local age of consent requirements
- If under the applicable age of consent, a parent/guardian must accept this Agreement on your behalf
3.2. Account Creation:
- You may register directly or use Apple/Google authentication
- You must provide accurate, complete information
- You are responsible for maintaining account security
- You may not impersonate others or use offensive usernames
- One account per person; no sharing accounts
4. Content Rights and Licenses
4.1. User Content:
- You retain ownership of content you create ("User Content")
- You are responsible for ensuring your content is legal and accurate
- You grant AI Pals a worldwide, perpetual, royalty-free license to use your content
- You grant other users a non-exclusive license to access your public content
4.2. Intellectual Property:
- AI Pals's content is protected by copyright, trademark, and other laws
- You receive a limited license to use content for personal, non-commercial purposes
- You may not sell, license, or exploit AI Pals's content
- All trademarks remain the property of their respective owners
5. Prohibited Activities
5.1. You may not:
- Infringe on intellectual property rights
- Post false, misleading, or harmful content
- Harass, abuse, or threaten others
- Distribute spam or malware
- Impersonate others
- Share personal data without consent
- Attempt to breach system security
- Reverse engineer the Services
- Violate applicable laws
6. Privacy and Data Protection
6.1. Your use of the Services is subject to our Privacy and Cookie Policy.
6.2. We comply with applicable data protection laws, including:
- General Data Protection Regulation (GDPR)
- California Consumer Privacy Act (CCPA)
- Other applicable regional privacy laws
7. Termination
7.1. AI Pals may terminate your access:
- At any time, with or without cause
- With or without notice
- Resulting in account deletion
7.2. You may terminate your account through the Services.
8. Disclaimers and Limitations
8.1. Warranty Disclaimer:
- Services provided "AS IS" and "AS AVAILABLE"
- No warranties of any kind, express or implied
- No guarantee of security, accuracy, or availability
8.2. Limitation of Liability:
- Maximum liability limited to $100.00 USD
- No liability for lost profits or consequential damages
- No liability for third-party content or services
9. Indemnification
9.1. You agree to indemnify AI Pals against claims arising from:
- Your use of the Services
- Your User Content
- Your violation of this Agreement
- Unauthorized account use
10. Modifications to Agreement
10.1. AI Pals may modify this Agreement:
- At any time
- By posting notice on the Site
- By sending electronic notice
- Changes effective upon posting
10.2. Your continued use constitutes acceptance of changes.
11. International Use
11.1. You must comply with all import/export laws.
11.2. Services may not be available in all jurisdictions.

13. Miscellaneous
13.1. Entire Agreement: This Agreement constitutes the entire agreement between you and AI Pals.

13.3. No Waiver: Failure to enforce any right doesn't waive future enforcement.
13.4. Assignment: You may not assign your rights; AI Pals may assign its rights.
13.5. Force Majeure: AI Pals shall not be liable for circumstances beyond reasonable control.
